The Supreme Court adopted a new "ABC test" for determining whether a worker should be considered an employee or independent contracted for purposes of wage orders. This Dynamex ruling has tested employers by requiring changes in contract language, while heightening concern for payment of certain taxes, overtime, and penalties as a result of reclassification.
