Be part of this interactive Table Talk to hear first-hand experience about what happens when residential placement is litigated, and how to be best prepared to properly address requests for residential placement. In addition to hearing directly from each other about what is involved in due process litigation, this Table Talk will also discuss cases regarding circumstances that arise outside of school, and the factors judges consider when deciding whether "home" issues appear to affect a student's ability to attend or participate in school. This can be true for students with IEPs and students not yet eligible for special education. In some cases, parents may even request placement at a residential treatment facility based on what is happening with the student outside of school. What is your district's duty to consider and address issues occurring outside of school, such as refusal to attend school, family violence, drug abuse, or antisocial behavior? The law is nuanced. This Table Talk will address recent case law focusing on when matters at home or outside of school trigger a District's responsibility to place a student in residential treatment.
