TITLE IX DISCRIMINATION PREVENTION


        CHECKLIST FOR K-12 SCHOOL DISTRICTS






        ADOPT APPROPRIATE WRITTEN POLICY
        District must adopt a Title IX policy that includes the following elements:
           > A statement that the district does not discriminate on the basis of sex.
           > A definition of sexual harassment and sexual assault.
           > Examples of the types of prohibited conduct.
           > The identity of the Title IX coordinator by name, title, office address, telephone number, and email address.
           > A grievance procedure that is prompt and equitable for both complainant and respondent.


        PUBLISH AND DISSEMINATE THE POLICY
        The policy must be widely available to students, employees, job applicants, parents, and vendors.
           > Make the policy readily accessible on the district’s website.
           > Include the policy in student handbooks, codes of conduct, school catalogues and employee materials.

        Post the Title IX information required under Education Code section 221.61 on the District and all school sites’
        Internet Websites in a “prominent and conspicuous” location.  This information should include the following:
           > the name and contact information (phone number and email) of the Title IX coordinator;
           > a statement of an individual’ s rights and the school’ s responsibilities under Title IX, including links to the
          U.S. Department  of Education Office for Civil Rights, Office for Equal Opportunity, and those rights listed in
          Education Code section 221.8; and
           > a description of how to file a complaint under Title IX, including information on (a) the statute of limitations, (b)
          the investigation procedures, and (c) where investigation forms from the U.S. Department of Education may be
          located.

        DESIGNATE A TITLE IX COORDINATOR
        Districts must designate at least one employee to coordinate Title IX compliance, with the following duties and
        authority:
           > Independence in order to avoid conflicts of interests.
           > Report directly to a member of senior leadership (e.g., superintendent or assistant superintendent).
           > Coordinate the investigation of all Title IX complaints.
           > Monitor outcomes, identify and address patterns, and assess effects on campus climate.


        TRAIN STAFF AND STUDENTS
        Generally, all training should include:
           > An overview of the district’s Title IX policy and grievance procedures, including filing complaints and addressing
          retaliation.
           > Practical information on how to prevent and identify sexual harassment and violence, including same-sex
          conduct.
