At the Crossroads of Discipline and Disability
The intersection of discipline for students with disabilities is complex, particularly so given the mounting empirical evidence against exclusionary school discipline. Recent data shows that students with disabilities are subjected to exclusionary school discipline at extremely disparate rates, calling into question the efficacy of punitive school discipline measures. Through case studies, hypotheticals and real-life examples, we will discuss manifestation determinations, disciplinary changes in placement, expulsions and expedited appeals, and positive alternatives to exclusionary school discipline that aim to support, rather than remove, this vulnerable student population in the school environment.

Alternative Placement Considerations
This session takes a deep-dive into the current trend of requests for the design of IEP placements outside the traditional school setting. The IDEA calls for individualized programming. And post-COVID, that seems to have taken on all new meanings. Whether the requests are for independent study, home/hospital instruction, home placement, hybrid programs, shortened days, virtual instruction, virtual services, some combination of these options, or some entirely individualized person option, the range of alternative options and requests is vast these days. During this session, we will evaluate the current legal landscape, with a focus on issue spotting and traps to avoid. We will also discuss the practical considerations of such alternative options, as well as the statutory and case law limitations on such personalized programming.

The MELT Legal Update (Major and Essential Legal Topics)
This portion examines the most significant court and administrative decisions of this past year, from key decisions to guidance at the federal and state levels, on the most critical and trending issues impacting special education.
