Governor Signs Legislation to Extend Layoff Notice Timelines for Classified Employees

School and community college districts are currently required to provide written notice to classified employees no less than 45 days before their effective layoff date if layoffs are necessitated by the reduction or elimination of classified services because of lack of work or funds.

Effective January 1, 2013, Assembly Bill ("AB") 1908 amends Education Code sections 45117 and 88017 to extend these notification timelines for classified employees from 45 to 60 days. AB 1908 makes no change to the requirement that classified employees subject to layoff due to the expiration of their specially-funded positions be given written notice of their layoff effective at the end of the school year on or before April 29.

School and community college districts must conform their existing personnel practices and policies to the new notice requirements and should engage in advanced planning when assessing their needs for classified employee layoffs.
