Have you heard? A school district has been ordered to administer medical marijuana to a student on campus and on district transportation pursuant to an IEP. Additionally, the FDA recently approved the first marijuana-based drug, which can now be prescribed by doctors. In light of the recent legal decision, and approval of Epidiolex, school districts need to be prepared to respond to requests from parents for administration of marijuana-based drugs, including understanding their obligations under the IDEA and Section 504 as well as the Education Code.
