School Districts are accountable to effectively manage and keep track of "at-risk" students, follow up on disenrollment issues, and also to search and serve special education students in a responsible and legally compliant manner. Case law has articulated that truancy can sometimes be a trigger for child find and assessment. Questions regarding the legal implications of truancy in the context of child find, eligibility determinations, IEP development, manifestation determinations, residential treatment center placement, and potential retaliation claims related to the initiation of truancy proceedings are many and varied.
